Sen. Jinggoy Estrada's bid for bail on a flood-control plunder charge will be tested in a Sandiganbayan courtroom from Oct. 20 to Nov. 12, with prosecutors lining up whistleblowers, DPWH district officials, NBI agents and Senate staff. The schedule was announced at pre-trial proceedings before the Fifth Division on Wednesday, Oct. 14, according to Jerod Orcullo of the Daily Tribune (Oct. 15).
Who will testify
Per the Tribune, the prosecution plans to present 21 witnesses in all: alleged whistleblowers, officials from various DPWH district engineering offices, NBI officials and Senate officials. Former DPWH Secretary Manuel Bonoan is expected among those named, but the report says it is not clear whether he would testify during the bail hearings or only in the main trial.
The Bonoan wrinkle
Bonoan was originally an accused in the plunder case. Prosecutors later moved to amend the charges to remove him from plunder so that he could serve as a flood-control witness, the Tribune reported. He is not off the hook entirely: he remains charged with graft alongside Estrada and other DPWH officials before the Sandiganbayan Second Division, which denied a similar prosecution motion to drop him from that case.
The result is a witness who is simultaneously a cooperating figure in one courtroom and a co-accused in another. That arrangement is legal, but it invites exactly the credibility questions the defense will want to press. Per the Tribune's related Sept. 14 coverage, Estrada's camp has already asked the Fifth Division to reconsider its decision allowing Bonoan's discharge as a state witness.
The allegations
According to the Tribune, Estrada allegedly received ₱573 million in infrastructure kickbacks from the DPWH in 2025 through "systematic deliveries." The Office of the Ombudsman said he helped insert projects into the DPWH infrastructure portfolio in 2025 in exchange for a "predetermined commission fee." The report notes this is the third time Estrada has been charged with plunder.
The Tribune article includes no direct response from Estrada or his camp, and none is available to us. These are allegations; Estrada is entitled to the presumption of innocence, and a bail hearing tests the strength of the prosecution's evidence, not guilt.
What to watch
Bail on a plunder charge turns on whether the evidence of guilt is strong, which is why prosecutors are bringing a full roster at the bail stage rather than saving it for trial. Watch whether Bonoan takes the stand, what the district engineers say about how projects were allocated, and whether the defense can use his dual status against him.
Context
Pulpulitiko has covered the broader flood-control prosecutions at the Sandiganbayan, including the bail hearing of ex-Speaker Martin Romualdez and the prosecution's rest in Sen. Rodante Marcoleta's plunder case, as well as Ombudsman Jesus Crispin Remulla's year-one tally of 39 flood-control cases.
